AN ACT

AMENDING TITLE 36, CHAPTER 7, ARTICLE 3, ARIZONA REVISED STATUTES, BY ADDING SECTION 36-842.01; RELATING TO ANATOMICAL GIFTS.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, chapter 7, article 3, Arizona Revised Statutes, is amended by adding section 36-842.01, to read:

36-842.01. Anatomical gift registry; purpose; immunity

A. TO EXPEDITE A MATCH BETWEEN IDENTIFIED ANATOMICAL GIFT DONORS AND POTENTIAL RECIPIENTS, THE [strike THE insert "AN"] ORGAN PROCUREMENT ORGANIZATION SHALL ESTABLISH AN ANATOMICAL GIFT REGISTRY THAT CONTAINS INFORMATION REGARDING PERSONS WHO HAVE EXECUTED A DOCUMENT OF GIFT.

B. THE [strike THE insert "AN"] ORGAN PROCUREMENT ORGANIZATION SHALL MAKE INFORMATION IN THE REGISTRY REGARDING POTENTIAL DONORS AVAILABLE TO ORGAN PROCUREMENT AGENCIES AND HOSPITALS ON A TWENTY-FOUR HOUR BASIS, SEVEN DAYS A WEEK.

C. THE [strike THE insert "AN"] ORGAN PROCUREMENT ORGANIZATION MAY RECEIVE VOLUNTARY CONTRIBUTIONS TO SUPPORT THE REGISTRY AND ITS ACTIVITIES.

D. THE [strike THE insert "AN"] ORGAN PROCUREMENT ORGANIZATION IS NOT SUBJECT TO CIVIL LIABILITY AS A CONSEQUENCE OF GOOD FAITH ACTS OR OMISSIONS RELATED TO THE GATHERING AND RELEASE OF INFORMATION RELATING TO THE ANATOMICAL GIFT REGISTRY. ALL ACTS AND OMISSIONS ARE PRESUMED TO BE IN GOOD FAITH UNLESS THE ACTS OR OMISSIONS ARE DONE WITH INTENT TO MALICIOUSLY CAUSE INJURY.

H2191: TECH CORRECTION: INDIGENT BURIAL
Minor change to section 11-600 on burial of indigent deceased. Apparent striker bus.

H2434: PEACE OFFICER BURIAL; STATE FLAG
The Peace Officer Standards and Training Board must provide a state flag at no cost to the next of kin of a deceased peace officer.

S1235: VETERANS; BURIAL
The article in statutes governing counties, which relates to burial of veterans, is repealed; and a new section in T41 on state government specifies that the veterans' affairs dept. is to provide for the burial of any honorably discharged military veteran or a surviving spouse, resident of this state at the time of death, who dies without sufficient means for burial expenses.

S1237: FUNERAL DIRECTORS
Several changes are made to the code on professions, relating to funeral directors and establishments, including adding to several definitions, such as "responsible funeral director" to specify one who is accountable for an establishment; adding to a section on disciplinary action, to note that the acts or ommissions of funeral establishment employees that violates regulating statute or related rules are considered to be the acts or omissions of the funeral establishment; more.
